Terms and Conditions

When you place your order, you agree to the following terms:

Seeds

After harvesting seeds, we segregate each variety into individual groups or “lots.” Several assessment seeds from each lot are used to test germination viability. Each lot has a target germination rate it must meet in order to become a product for sale. If the target germination rate is not achieved the entire seed lot is considered inferior, not for sale and is discarded. All of our seeds meet and greatly exceed the USDA standards for germination rates as they all have germination rates that exceed 80%.

Nearly all of the seeds at our farm come from isolated plants. Although the plants are isolated, they are open-pollinated so variation can exist. A portion of our seeds are also from new crosses that still might be unstable. All of the new crosses have different characteristics so their shapes could vary. We have a very limited supply of seeds and cannot replace seed packets or refund orders due to germination issues.

Live Plants and Trees

We guarantee that your plants and trees will arrive alive. Please email us if you're not satisfied within the first 24 hours of receiving your plant. We will require that you send us a photo so that we can help you address the issue - but once we receive your photos, we will review your concerns and provide guidance on how to resolve the issue.

Unfortunately, if you've given your plants less-than-optimal care or haven’t followed our instructions for your live plant, your purchase isn't covered by our guarantee.

*Replacement shipping costs are at the customer’s expense.

Germination Times and Growth Rates

Seeds and live plants are like humans: they all grow differently! We cannot predict how quickly your seeds will germinate, nor can we predict how fast your plants will grow. All seeds and plants are unique and must be nurtured properly in a suitable environment. Because every plant is unique and every growing environment is unique, your results will vary.

Growing Practices and Environment

We do our best to give you the essentials for starting your seeds and plants, but we're unable to provide every detail for planting. It's important to do your research as well. Though we wish we could guarantee the success of every seed and plant once it is planted, we cannot. Pests, planting outside of recommended growing zones, neglect, extreme weather damage, drought, disease and poor soil conditions can impact your chances of success.

Plants are living organisms and are subject to unpredictable conditions every day. However, we do our best to ensure that you are getting a quality product. Seeds and plants are our business, and we strive to build customer relationships based on trust and reliability. If you have any questions about plant hardiness or the best trees and plants for your area, contact your local County Agricultural Extension Office.

Shipping

Seed orders typically ship within 48 hours. Live plants typically ship on Mondays, Tuesdays, and/or Wednesdays to prevent them from sitting idle at the post office on Sunday. External factors could delay shipping time. Because these are estimates, exact shipping and handling cannot be guaranteed.

Shipping live plants has its challenges and weather can often impact shipping. Some plants are cold sensitive, so it is best to ship them during months with mild temperatures. If you choose to order your plant during a time period with extreme temperatures, Tyler Farms is not responsible for any temperature related damage.

If you would like to delay your delivery date, please email us and we would be happy to work with your preferred schedule.

All orders are at the buyer's risk. Any order that is claimed as not received will not be resent or refunded unless the order is returned to us by USPS, or unless the tracking information deems it lost. Please be aware that shipping times can vary widely - from several days to several weeks (international).  We are unable to offer tracked international shipping, but we can email an image of the order before shipment so we can verify the destination address with you and you know exactly what you will receive.

Pruned Plants and Deciduous Trees

We prune branches from young trees and plants to promote faster growth and better branching later. Your young plant may be smaller or skinnier upon arrival, but be patient as it will grow taller and branch out faster because it has been pruned.

Deciduous trees may have minimal branching, or no branching while they're still young.

Damaged Orders

At Tyler Farms, we guarantee that your order is packed and shipped carefully to ensure a safe delivery. For this reason, it's extremely rare that packages are broken or damaged in transit. If you've received a damaged package, please email us with a picture of the package prior to unboxing it so we can address the issue with USPS.

Product Descriptions

Our pictures represent plants and trees at maturity to give you an idea of their future appearance. Typically, your tree or plant will not look as pictured upon arrival. Younger trees are naturally thinner in shape and less branched than mature trees but will grow fuller with time.
